
| Terms and Conditions Our Contract These Terms and Conditions govern the usage of the DIY Trade Centre website the supply of goods sold by DIY & Trade Centre (Subsidiary of Hoyland Common DIY Haven) 4 Hoyland Road Hoyland Common Barnsley South Yorkshire S74 0LY ("we" and "us") to the customer, named on the order form provided on the DIY & Trade Centre website ("you"). Together with the completed order form, these Terms and Conditions constitute the entire and only agreement between us in relation thereto. All orders are subject to availability, any order & payment will be acknowledged by email but that no Contract is entered into until an e-mail is sent confirming that the goods have been dispatched. Our acceptance of your order by delivery of the goods constitutes a legally binding contract between us on these terms and conditions. Price & Payment The price payable for the goods you order is as set out on our website at the time you place your order, plus any charges for carriage and insurance as set out in the order form. We must receive cleared funds in respect of payment for the whole of the price of the goods you order, and any applicable charges including carriage and insurance, before your order can be accepted unless we have agreed otherwise in advance in writing. If you are an account customer, payment shall be made in full within 30 days following date of invoice. We operate a strict 30 day policy. We may withdraw credit facilities if you fail to make payment when due. If payment is not made when due, interest is calculated daily and payable at the rate of 3 per cent over current Lloyds TSB bank base rate on the amount outstanding from the due date for payment until receipt by us of the full amount (including any accrued interest) whether before or after judgment, together with any reasonable legal or other recovery costs. Delivery cost quoted is for UK Mainland only. Please contact us for delivery costs outside of this area. Despatch Of Goods If your order is held in stock our intention is to dispatch goods within 48 hours of receipt of a completed and verified order form, together with cleared funds. So should reach you within 2 - 7 working days. However if products are not in stock this may occur more so in out of season periods or in the event of large or specialised orders. In this case we would normally receive your order from the supplier with 1 - 3 weeks and then dispatch it to you via Next Day delivery. Delivery & Title Unless you tell us you wish to collect the goods, we will deliver them in accordance with your order. A valid signature will be required on collection or delivery. Immediately prior to dispatch of the goods to you, title in the goods will pass to you. In the unlikely event that you have not received all the goods within 30 days of the date of delivery (or where you have requested a delayed dispatch within 30 days of the requested dispatch date), you must notify us immediately. We aim to dispatch all items via courier and insured to the value of £500, in some circumstances it is not cost affective in which case the item will be sent out via Royal Mail Recorded Post. All items delivered will require a signature, Sorry we are unable to request items to be left without a signature. Please check the packaging on arrival if there is any noticeable damage to the packaging please make a note on the form signed or ask the driver to put it on his system. Please note once your item has been dispatched by us, the responsibility for the consignment is take by the courier on our behalf. In the unlikely event that an item is delayed lost or damaged we will do our best to track any delayed item but we are reliant on the third party and their systems. Any item *deemed lost or **damaged will be replaced. (* An item will only be deemed lost after 14 days following dispatch). (**We may require evidence of any damaged item and in some circumstances require the item be sent back via Royal Mail Recorded Delivery Only) We will reimburse you the postage cost incurred. Availability While we endeavour to hold sufficient stock to meet all orders, if we have insufficient stock to supply or deliver the goods ordered and paid for by you, we may, at our discretion, supply or deliver a substituted product or refund you the price paid for such goods as soon as possible and in any case within 30 days or, in the case of an account customer, we may, in our absolute discretion, as soon as possible raise a credit to offset the amount invoiced to you. Cancellation & Returns Cancellation prior to dispatch of your order must be received by mailing, faxing, emailing or phoning: the number or address outlined in the "contact us link" no later than 24hrs before dispatch. You may return your order by giving us notice of you intention within 7 days of the date you received the goods. Such notice may be given by mailing, faxing or emailing to the address as set out on the contact us link. If you are cancelling because of any problem with the goods, please inform us of the problem at the time. We can only act on information we have to hand. Return of unwanted items, you must return the goods to us at your cost, in the original packaging & labels, unused & in the same condition as it was when it left us. A restocking fee may be charged at 10% of the value of the goods or a minimum of £25. Any delivery charges incurred are non refundable, we will only meet the cost of returned goods by prior agreement only if they are faulty, incorrect goods picked & dispatched by us or because of unsuitable substitution by us. Wherever we are to meet the cost we must nominate the carrier. If an item is returned to ourselves as undelivered following the couriers attempts and a contact being left. The cost of the return postage plus the standard £10 administration fee will be charged to you. Liability If you have notified us of a problem with the goods, we will either make good any shortage or non-delivery; replace or repair any goods that are damaged or defective upon delivery; or refund to you the amount paid by you for the goods in question. We will not be liable to you for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions. This does not affect your statutory rights as a consumer, nor is it intended to exclude our liability to you for fraudulent misrepresentation or for death or personal injury resulting from our negligence. Termination We may suspend further supply or delivery, stop any goods in transit or terminate our contract by notice in writing to you if you are in breach of an obligation hereunder or you become unable to pay your debts when they fall due or proceedings are commenced by or against you alleging bankruptcy or insolvency. Upon termination, your indebtedness to us becomes immediately due and payable and we shall be under no further obligation to supply goods to you. Force Majeure We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes, civil unrest or natural disasters). Design and Reproduction Quantities and measurements are approximate. We can not and will not be held responsible for any errors or omissions All Trademarks Acknowledged. Exact products may vary from that shown. All products subject to availability. Please Note Size Please note when purchasing fire spares. The size stated within the description i.e. 16" or 18" is a nominal size. This refers to the actual size of the opening of the fire, Not the actual size of the product The sizes given are for guidance only, each item is made to fit the appropriate fire. General If any part of these conditions is invalid, illegal or unenforceable (including any provision in which we exclude our liability to you) the validity, legality or enforceability of any other part of these conditions will not be affected. This contract shall be governed by and interpreted in accordance with English law. VAT All prices include VAT at 17.5% subject to changes in taxation. Vat No. 845 229909 Age Requirements Where the law requires a minimum age limit for the purchase of specific goods, you must confirm that you are over the required age limit and that delivery will be accepted by a person over the required age limit.
